This section outlines the terms of sale ("Terms") for products available from the Canon eStore. In these Terms, Canon Canada Inc. is referred to as "CCI" or "We", and you the buyer are referred to as "You" or "Your", as applicable.

1. Intended Customer.
The Canon eStore is intended for customers purchasing products for personal or small office/home office use. Orders are limited to no more than ten (10) of any one item. Resale of products purchased under these Terms of Sale is prohibited. This resale prohibition is a material condition to Your rights under these Terms of Sale, and it is agreed that any direct or indirect distribution, transhipment and/or sale of products by You or others purchasing through You will be a material breach of these Terms of Sale and will result in serious and irreparable harm to Canon Canada for which money damages will not be adequate remedy. In the event of such breach, You agree that Canon Canada, in addition to any other remedies it may have at law and/or in equity, will be entitled to injunctive relief to prevent any threatened or continued breach and to specifically enforce this provision.
We will not knowingly accept any order from a person under the age of majority in their respective province or territory of residence. You confirm that You are not under the age of majority.
2. AVAILABILITY OF PRODUCTS AND SERVICES
The products and services displayed on this Site are intended for sale in Canada and may not be available for purchase in Your particular country or locality. The reference to such products and services in the Site does not imply or warrant that these products or services will be available at any time in Your particular location.
The prices advertised on this site are for Canon eStore orders only. All prices are listed in Canadian dollars. Prices and the availability of items are current at the time You access this site. The precise prices of each product purchased by You and the total amount to be paid by You for such products will be clearly displayed during the checkout process. Any promotions offered on the Canon eStore are only available for purchases made at the Canon eStore unless otherwise specified. While Canon eStore uses reasonable efforts to include complete and up-to-date information, the Canon eStore cannot guarantee the accuracy of all the information contained on this website. Accordingly, Canon eStore assumes no responsibility for any errors or omissions in the content of this website.

4. SHIPPING AND HANDLING FEES
The rate which will appear for "Shipping Cost" includes shipping and handling fees, as detailed further below. The shipping and handling fees are intended to compensate Canon Canada for the cost of handling Your order, packaging the product(s) You have purchased, and delivering them to You and/or to the recipient(s) You designate. The precise amount of the shipping and handling fees will be clearly displayed during the checkout process.

5. SHIPPING RATES, DETAILS AND RESTRICTIONS

One Purolator landing page enter the postal code "L9T 5V7" in the "Ship From" postal code field. In the "Ship To" postal code field enter the postal code you are having your order delivered to.
Click the calendar icon and select the "Date of Shipment" based on the following criteria:
- Orders placed before 1:00 PM EST on a business day ship from the Canon warehouse the same day
- Orders placed after 1:00 PM EST it will ship the next business day
- Orders placed on Saturday, Sunday or on a statutory holiday will ship the next business day
Click "Get Estimate".
Your order will be shipped either Purolator Regular ('Ground') or Purolator Express ('Air'). The estimated delivery date will appear in the under the column labeled "Arrival Time".
Avoid Delays in the Delivery of your Order
For your protection, all orders are screened for fraud. Please use the exact information that appears on your credit card statement when completing your billing information. Incomplete or incorrect information may result in a delay in processing and delivery of your order.
All orders are shipped from our warehouse facility in Mississauga, Ontario. Orders placed by 1:00 PM (EST) are usually shipped out of our warehouse the same business day (with the exception of weekends or Civic Holidays).
For Your protection, some orders go through our fraud prevention department. If Yours is selected, We will quickly notify You (doing this may cause a delay).
Use the exact information that appears on Your credit card statement when completing the billing information. Incomplete or incorrect information may result in a delay in processing and delivery of Your order.
The Canon eStore only accepts and ships orders to street addresses within Canada. We are unable to ship to either PO Boxes or Rural Routes at this time. We do not allow address changes after an order has been confirmed.
Order delivery time is based on availability and shipment option as well as processing time. Delivery dates are best estimates only based on the number of business days from the date of shipment. Canon Estore orders will be shipped via Purolator Regular courier unless Express is selected.
Orders shipped via Purolator Regular are usually received by customers within 3-6 business days. For Newfoundland & Labrador, Yukon, Northwest Territories and Nunavut, allow extra time for delivery.
Orders requested to be shipped via Purolator Express, should arrive at most major centres by next business day. (Example: If You place Your order before 1:00 PM EST on Monday and You select Purolator Express delivery, You should receive Your order on Tuesday for most major centers (with the exception of weekends or Civic Holidays). If You place Your order after 1:00 PM EST on Monday and You select Purolator Express delivery, You should receive Your order on Wednesday.)
Please note our warehouses do not ship on weekends or Civic Holidays. Therefore, if You place an order before 1:00 PM EST on Friday and select Purolator Express delivery, it should arrive on Monday for most major centers. If You place an order after 1:00 PM EST on Friday and You select Purolator Express delivery, it should arrive on Tuesday.
6. ENVIRONMENTAL HANDLING FEES
Please be advised that some items sold on the Canon eStore may be subject to an Environmental Handling Fee as required by Your provincial government. Environmental Handling Fees are used to support provincial recycling and disposal programs.
The Canon eStore charges Environmental Handling Fees on items that We ship to provinces or territories where We are required to do so. The Environmental Handling Fee amount reflects the province's applicable rate. The precise amount of the Environmental Handling Fee will be clearly displayed during the checkout process.
7. HANDLING FEES FOR UNDELIVERABLE PACKAGES
Occasionally packages are returned to Canon Canada as undeliverable. When Purolator returns an undeliverable package to Us, We will attempt to notify You and You will be responsible for contacting Us to make arrangements for reshipment and, if applicable, provide Your credit card number to cover any additional handling fees. Orders that have been returned to Us as undeliverable are subject to a handling fee as detailed below.

8. TAXES AND TAX EXEMPT PURCHASING
Appropriate taxes are charged on all orders based on the province to which shipment is made. Canon Canada cannot accept tax exempt orders. The precise amount of the applicable taxes will be clearly displayed during the checkout process.
Prior to submitting Your payment information, You will have the opportunity to review the applicable sales tax and this information will be presented in a manner that ensures that You are able to easily retain it and print it.
9. PAYMENT OPTIONS
Canon Canada accepts MasterCard or Visa. You must use a Canadian credit card with Canadian billing and shipping addresses. Your card will not be charged until Your order ships. If Your card expires before the order is shipped, We will notify You, and ask You to enter the credit card number again with the new expiration date. When You place an order at the Canon eStore, Your credit card information is encrypted using a VeriSign Secure Sockets Layer (SSL) Certificate. Credit card information is not stored on the Canon eStore system; therefore it must be re-entered each time You place an order.
10. TRACKING YOUR ORDER
While every effort is made to ensure timely deliveries, Canon Canada shall not be responsible for delivery delays for Regular and Express courier shipments due to causes beyond its control, including but not limited to weather conditions, strikes, lockouts, or force majeure.
Tracking Your order may be done from either the email confirmation of Your shipped order, or by clicking on the order number in the "Purchase History" in the "My Account" section. You will be taken directly to the shipment/tracking information on the Purolator web site. From this page, You can see the status of Your shipments in the delivery process.
11. ORDER STATUS
You may see Your order status at any time throughout the process by viewing Your recent orders in the "Orders"section of your "Canon Account". You will also receive email confirmation for submitted and shipped orders.

12. SIGNATURE IS REQUIRED FOR DELIVERY
Most of our shipments contain valuable merchandise. If You will not be at the shipping address to accept delivery of Your product, consider shipping the item to an address where someone You trust will be available to sign for Your package. Please note that We are not able to adjust the shipping address once a package has left Canon Canada's warehouse.
13. TITLE AND RISK OF LOSS
Title to the Product and risk of loss or damage to the Product will pass to You upon shipment from Canon Canad's or its designee's facility.
14. ORDER CONFIRMATION AND CANCELLATION
Canon Canada reserves the right to decline orders at any time. Order confirmation, backorder notification and shipment confirmation are sent via e-mail to the e-mail address You used to create a Canon eStore account and this information will be presented in a manner that ensures that You are able to easily retain it and print it. All orders are electronically transferred to the fulfillment center at the time they are placed. If an order is processed in error, contact customer service immediately at 1-800-521-9965.
15. CANON ESTORE RETURN POLICY
The Canon eStore will accept for return or exchange only new (not refurbished) or defective merchandise purchased at the Canon eStore, in accordance with the provisions and time frames for return as set out below. All merchandise returned to Canon Canada must be packed in the original packaging including any accessories, manuals, documentation and registration that shipped with the product (such as manuals, cables, etc.) and a copy of the invoice/packing slip included to be eligible for return or exchange. [For Quebec residents, please refer to the Consumer Protection Act for any rights which you may have.]
Opened merchandise may be subject to a restocking fee. In the event that returned merchandise ordered has items missing, the return may be refused, or the value of the missing materials may be deducted from the total credit amount.
Shipping and handling charges are non-refundable; however, your original shipping cost will be refunded if you are returning an item because of an error on our part, or we have determined that the product is defective. 16. REFURBISHED PRODUCTS
If You have chosen to purchase a refurbished Product, quantities are limited. Refurbished products are those which have been returned to Canon Canada. They have been tested to ensure they perform properly, and are under warranty. Refurbished products may have small blemishes due to handling but this will not affect performance. Refurbished products may not contain exactly the same media/software as new models. Canon Canada does not accept returns on Refurbished Products except in the case where products are received by You in damaged or defective condition in which case, Canon Canada will, at its sole option, either provide a replacement with the same model or an equivalent model. 17. TIME FRAME AND SHIPPING INSTRUCTIONS FOR RETURNS/EXCHANGES
All returns and exchanges must be accompanied by a Return Merchandise Authorization ("RMA") number. To return or exchange defective or unopened merchandise, You must (a) request and obtain an RMA number within 30 calendar days of the date the order was delivered to the delivery address specified on the order and (b) return the merchandise to Canon Canada within the Return Period of 30 calendar days of the date the order was delivered to the delivery address specified on the order. Canon Canada's address can be found on Your packing slip. To receive an RMA number for returns or exchanges, call Canon Canada toll-free at 1-866-521-9965. The RMA number must be clearly written on the outside of the shipping package. We recommend that You ship the merchandise You are returning via courier or other delivery service that provides tracking information and insurance, since Canon Canada will not be responsible for packages lost or damaged in transit to Canon Canada. We will not accept any returns or exchanges after the Return Period. [For Quebec residents, please refer to the Consumer Protection Act for any rights which you may have.]
18. CANON COLLEGE E-TICKETS
For Canon College Tickets, any returns must be made within 30 calendar days of the date the product was purchased or 48 hours before the event date, whichever occurs first.
19. CAREPAK EXTENDED SERVICE PLAN RETURN POLICY
To request a return, You must call Canon Canada toll-free at 1-866-521-9965 within thirty (30) calendar days of the purchase date. Return requests will not be accepted for any CAREPAK that has a service claim made against it.
[Please note that this clause is inapplicable in Quebec.] Canon Canada's only express warranty (if any) on a product is made only to You in accordance with the limited warranty, if any, that Canon Canada may ship with the product. Unless specifically required by applicable law, Canon Canada makes no other representation, offers no other express warranty, condition or guaranty of any kind, express or implied, statutory or otherwise, including without limitation, any warranty or condition with regard to quality, durability, merchantability or fitness for a particular purpose. If any product is defective at the time of delivery to You, Your sole remedy will be to return the product to Canon Canada for replacement or refund as described in these Terms. Canon Canada reserves the right to modify its warranty at any time, in its sole discretion.
21. OUR LIABILITY
[Please note that this clause is inapplicable in Quebec.] UNLESS OTHERWISE REQUIRED BY PROVINCIAL OR TERRITORIAL LEGISLATION SPECIFICALLY GOVERNING THE TERMS OF CONSUMER SALES, NEITHER CANON NOR ANY SERVICE PROVIDER SHALL BE LIABLE FOR: (A) PERSONAL INJURY OR PROPERTY DAMAGE; (B) LOSS OR DAMAGE TO IMAGES PROVIDED BY YOU TO CANON (WHETHER OR NOT SUCH IMAGES ARE IN THE POSSESSION AND/OR CONTROL OF CANON); OR (C) LOSS OF REVENUE OR PROFIT, FAILURE TO REALIZE SAVINGS OR OTHER BENEFITS, EXPENDITURES FOR SUBSTITUTE PAINTINGS, PRODUCTS OR SERVICES, STORAGE CHARGES OR OTHER SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE, MISUSE OR INABILITY TO USE THE PRODUCT AND/OR PAINTING, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE AND BAILMENT) AND EVEN IF CANON OR ANY SERVICE PROVIDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOR SHALL RECOVERY OF ANY KIND AGAINST CANON OR ANY SERVICE PROVIDER BE GREATER IN AMOUNT THAN THE PURCHASE PRICE OF THE PAINTING CAUSING THE ALLEGED DAMAGE. WITHOUT LIMITING THE FOREGOING, THE PURCHASER ASSUMES ALL RISKS AND LIABILITY FOR: (A) LOSS, DAMAGE OR INJURY TO PERSONS AND PROPERTY OF THE PURCHASER OR OTHERS, ARISING OUT OF THE POSSESSION, USE, MISUSE OR INABILITY TO USE THE PRODUCT AND/OR PAINTING SOLD BY CANON; AND (B) ANY LOSS OR DAMAGE TO IMAGES PROVIDED TO CANON (WHETHER OR NOT SUCH IMAGES ARE IN THE POSSESSION AND/OR CONTROL OF CANON).
22. APPLICABLE LAW
The Terms and any related sale shall be deemed to have been made in the Canadian province where you reside (the "Province") and shall be governed in all respects by the laws of the Province and the federal laws applicable therein, without regard to its conflicts of law principles. You submit to the exclusive jurisdiction of the courts situated in the Province for all disputes or disagreements arising pursuant to, or transactions and relationships contemplated by these Terms and waive any objections as to personal jurisdiction or as to the laying of venue in such courts due to inconvenient forum or any other basis and undertake to file no action or bring no complaint in any other court.
