Canon Canada Inc. EStore Sale Terms and Conditions


This section outlines the terms of sale (“Terms”) for products available from the Canon eStore. In these Terms, Canon Canada Inc. is referred to as “CCI” or “We”, and you the buyer are referred to as “You” or “Your”, as applicable.

1.       Intended Customer.

a.       The Canon eStore is intended for customers purchasing products for personal or small office/home office use. Orders are limited to no more than ten of any one item. Resale of products purchased under these Terms is prohibited. This resale prohibition is a material condition to Your rights under these Terms, and it is agreed that any direct or indirect distribution, transhipment and/or sale of products by You or others purchasing through You will be a material breach of these Terms and will result in serious and irreparable harm to CCI for which money damages will not be adequate remedy. In the event of such breach, You agree that CCI, in addition to any other remedies it may have at law and/or in equity, will be entitled to injunctive relief to prevent any threatened or continued breach and to specifically enforce this provision

b.       will not knowingly accept any order from a person under the age of majority.

   

2.       Pricing.

The prices advertised on this site are for Canon eStore orders only. All prices are listed in Canadian dollars. Prices and the availability of items are subject to change without notice. Any promotions offered on the Canon eStore are only available for purchases made at the Canon eStore unless otherwise specified. We are not responsible for typographical or photographical errors.

 

3.       Fees, Taxes & Tax Exempt Purchasing

The shipping and handling charge is intended to compensate CCI for the cost of handling Your order, packaging the product(s) You have purchased, and delivering them to You and/or to the recipient(s) You designate. Prior to submitting Your payment information, you will have the opportunity to review the product prices, sales tax, and shipping and handling charges. We do not allow address changes after an order has been confirmed. Delivery dates are best estimates only based on the number of business days from the date of shipment. Appropriate taxes are charged on all orders based on the province to which shipment is made. CCI cannot accept tax exempt orders.

 

Environmental Handling Fee

Please be advised that some items sold on the Canon eStore may be subject to an Environmental Handling Fee as required by your provincial government. Environmental Handling Fees are used to support provincial recycling and disposal programs.

The Canon eStore charges Environmental Handling Fees on items that we ship to provinces or territories where we are required to do so. The handling fee amount reflects the province’s applicable rate. The handling fee will be displayed during the checkout process.

 

4.       Payment Options

CCI accepts MasterCard or Visa. You must use a Canadian credit card with Canadian billing and shipping addresses. Your card will not be charged until your order ships. If Your card expires before the order is shipped, We will notify you, and ask You to enter the credit card number again with the new expiration date. When You place an order at the Canon eStore, Your credit card information is encrypted using a VeriSign Secure Sockets Layer (SSL) Certificate. Credit card information is not stored on the Canon eStore system; therefore it must be re-entered each time You place an order.

 

5.       Order Confirmation & Cancellation

a.       CCI reserves the right to decline or cancel orders at any time. Order confirmation, backorder notification and shipment confirmation are sent via e-mail to the e-mail address You used to create a Canon eStore account. We assume no responsibility for issues resulting from such declines, cancellations, or e-mail notification failure. All orders are electronically transferred to the fulfillment center at the time they are placed, and they cannot be cancelled by You. If an order is processed in error, contact customer service immediately at 1-800-521-9965 for instructions.

b.       CCI will accept orders for shipment only to Your location (a street address is required) in Canada. Some restrictions may apply. No shipments will be made outside Canada or to a P.O. Box address.

   

6.       Canon eStore Return Policy

Not all products purchased at the Canon eStore can be returned. The Canon eStore will accept for return or exchange only new (not refurbished) or defective merchandise purchased at the Canon eStore, in accordance with the provisions and time frames for return as set out below.  Opened merchandise may be subject to a restocking fee.

Shipping and Handling Fees
Shipping and handling fees from Your original order will not be refunded, unless the merchandise is determined by CCI, in its sole discretion, to be defective. All merchandise returned to CCI
must be packed in the original, packaging including any accessories, manuals, documentation and registration that shipped with the product (such as manuals, cables, etc.) and a copy of the invoice/packing slip included to be eligible for return or exchange.

IMPORTANT: In the event that returned merchandise ordered has items missing, the return may be refused, or the value of the missing materials may be deducted from the total credit amount.

   

Restocking Fee

CCI reserves the right to assess a restocking fee of up to 20% on any opened merchandise. The restocking fee will be deducted from the total credit amount.

A 20% restocking fee will be charged on all returned items which are not packaged in the original product packaging or are missing warranty cards, manuals or any accessories.

 

Refurbished Products

All Sales are Final. Quantities are limited. Refurbished products are those which have been returned to CCI. They have been tested to ensure they perform properly, and are under warranty. Refurbished products may have small blemishes due to handling but this will not affect performance. Refurbished products may not contain exactly the same media/software as new models.  CCI does not accept returns on Refurbished Products except in the case where products are received by You in damaged or defective condition in which case, CCI will, at its sole option, either provide a replacement with the same model or an equivalent model.

Time Frame and Shipping Instructions for Returns/Exchanges
All returns and exchanges must be accompanied by a Return Merchandise Authorization (“RMA”) number. To return or exchange defective or unopened merchandise, You must (a) request and obtain an RMA number within 14 calendar days of the date the order was delivered to the delivery address specified on the order and (b) return the merchandise to CCI within the Return Period of 14 calendar days of the date the RMA number was issued by CCI. CCI’s address can be found on Your packing slip. To receive an RMA number for returns or exchanges, call CCI toll-free at 1-866-521-9965. The RMA number must be clearly written on the outside of the shipping package. We recommend that You ship the merchandise You are returning via courier or other delivery service that provides tracking information and insurance, since CCI will not be responsible for packages lost or damaged in transit to CCI. We will not accept any returns or exchanges after the Return Period.

CAREPAK Extended Service Plan return policy
To request a return, You must call CCI toll-free at 1-866-521-9965 within 30 calendar days of the purchase date. Return requests will not be accepted for any CAREPAK that has a service claim made against it.

7.       Miscellaneous

a.       Title and Risk of Loss. Title to the Products and risk of loss or damage will pass to You upon shipment from CCI or its designee's facility. Claims for loss or damage will be deemed waived unless presented to CCI in writing within 30 days of delivery of each shipment.

b.       Warranty. CCI's warranty (if any) on a product is to the first end user or consumer only, in accordance with the limited warranty that CCI may ship with the product. Unless specifically required by applicable law, CCI makes no other representation, warranty, condition or guaranty of any kind, express or implied, statutory or otherwise, including without limitation, any warranty or condition with regard to quality, durability, merchantability or fitness for a particular purpose. If any product is defective at the time of delivery to You, Your sole remedy will be to return the product to CCI for repair, replacement or refund as described in these Terms. CCI reserves the right to modify its warranty at any time, in its sole discretion.

c.        Availability of Products and Services. The products and services displayed on this Site are intended for sale in Canada and only may not be available for purchase in Your particular country or locality. The reference to such products and services in the Site does not imply or warrant that these products or services will be available at any time in your particular location.
